ABOUT THE BOOK
“A book is a device to ignite the imagination”
—Alan Bennett
Intellectual property (IP) encompasses the products of human intellect, such as inventions, literary and artistic works, as well as symbols, names, images, and designs utilized in trade. Intellectual property rights represent the entitlements granted to individuals for the works they have generated through their mental creativity. They usually give the creator an exclusive right over the use of his/her creation for a certain period. The purpose of intellectual property law is to allow the people who create and invent things to profit from their work a right that is had by a person or by a company to have exclusive rights to use its own plans, ideas, or other intangible assets without the worry of competition, at least for a specific period of time. These rights can include copyrights, patents, trademarks, and trade secrets.
These rights may be enforced by a court via a lawsuit. The reasoning for intellectual property is to encourage innovation without the fear that a competitor will steal the idea and / or take the credit for it.
Intellectual property rights protect the interests of creators by giving them property rights over their creations. Generally speaking, IP law aims at safeguarding creators and other producers of intellectual goods and services by granting them certain time limited rights to control the use made of those productions.
With the establishment of the World Trade Organization (WTO), the importance and role of the intellectual property protection has been crystallized in the Trade-Related Intellectual Property Systems (TRIPS) Agreement. Realizing the need and importance of IPR the ICAR has introduced a course on IPR at graduate levels in all SAUs and agricultural colleges in India. The book provides much needed information for graduates in agriculture, horticulture, forestry etc.
Beyond territories, for structuring businesses and advocating research, the use of intellectual property protection has been a subject of debate. It has been recognised worldwide that intellectual property protection serves to provide a fillip to knowledge-based economies. In the era of liberalisation
and globalisation, the need for cross border trade and services has further stimulated more research in this discipline.
At times where nations across are forcing each other to bring in stringent norms for the protection of intellectual property, it has become imperative to understand the need of the subject at graduation level.
